MALONE -- Five more people facing state charges linked to a family-run marijuana-smuggling network entered pleas in Franklin County Court.

Police say they are part of a drug-trafficking association that ran more than $4 million worth of marijuana from Canada to the Albany area.

Six people -- including a Malone woman and her two sons -- are in federal custody facing conspiracy charges for bringing at least 220 pounds of pot through Franklin County.

The people who appeared before County Court Judge Robert G. Main on Friday were:

Thomas Nesbitt, 28, of 87 Bird Road, Constable, who pleaded not guilty to first-degree criminal sale and first-degree criminal possession of marijuana, stemming from an incident April 5.

He also pleaded not guilty to first-degree criminal sale and first-degree criminal possession of marijuana, stemming from an incident April 10.

His bail was set at $75,000 cash bail for each pair of charges, and he was returned to County Jail.

Wade A. Cayea, 26, of Pine Grove Apartments, Malone, who pleaded not guilty to first-degree criminal sale of marijuana and was returned to County Jail on $25,000 cash bail or $50,000 bail bond.

Ann Fournier, 21, of 28 Clay St., Malone, who pleaded not guilty to first-degree attempted sale of a controlled substance (marijuana) and fourth-degree criminal sale of marijuana.

She was returned to County Jail on $5,000 cash bail or $10,000 bail bond.

Another person accused in the case who was previously arraigned on marijuana-related charges was Fournier's boyfriend, Matthew LaBrake, 21, of U.S. Route 11, Malone, who is being held on $50,000 cash bail or $100,000 bail bond.

Seth Lodge, 28, of Schenectady pleaded not guilty to charges of third-degree criminal possession of a controlled substance, cocaine.

His case was adjourned until May 31 at 9:30 a.m., and he was taken to County Jail, where he is being held on $50,000 cash bail or $100,000 insurance bond.

Three others pleaded guilty to lesser charges and are expected to be sentenced June 18.

Michael Benware, 37, of Fayette Road, Malone pleaded guilty to third-degree criminal possession of marijuana and is being held in County Jail on $25,000 cash bail or $50,000 bail bond.

Kevin Welch, 28, of Schenectady, pleaded guilty to third-degree attempted possession of a controlled substance (cocaine) and is being held in County Jail without bail.

Samantha Ryan, 19, of Schenectady pleaded guilty to fifth-degree attempted criminal possession of a controlled substance (cocaine) and was released under the supervision of the County Probation Department.

Jackaleen Theriault, 54, and her sons Danny Theriault, 33, of North Bangor and Denny Theriault, 18, of Malone, along with Chad Fellers, 41, of Constable; Jared Callahan, 28, of Schenectady; and Joshua Spaulding, 22, of Constable are in federal custody.

The alleged source of the Canadian-grown pot, David Sunday, 35, of Snye, Quebec, remains at large.

Spaulding also faces state-level drug-sale and -possession charges.
