Brenda J. Rabideau

MOOERS FORKS -- The felony hearing for a woman accused of trying to kill her husband was canceled Friday.

While behind bars at the Clinton County Jail, Brenda Rabideau met with attorney Daniel Gaudreau and asked to waive her scheduled felony hearing, though she reserved the right to have it at a later date.

The hearing will determine whether the case against her will move forward.

Rabideau, 50, had been living in the Ellenburg Depot area since she and her husband separated but allegedly went to her former Bush Road home Tuesday morning and used a .22-caliber rifle to fire multiple shots at her estranged husband, Ricky Rabideau.

As Mr. Rabideau attempted to flee, one of the shots hit him in the lower back.

Bleeding and frantic, he was able to escape the gunfire when a delivery truck pulled up to the residence and the driver gave him a ride to safety, according to police and witness reports.

He was taken to CVPH Medical Center for treatment.

Senior Investigator Patrick Mitchell was able to reach Mrs. Rabideau by phone inside the 712 Bush Road home, where she allegedly set fire to a dining room-table. About 30 minutes later, she surrendered.

After Mrs. Rabideau was taken to the Plattsburgh hospital for a possible prescription overdose, she was arraigned on charges of second-degree attempted murder, first-degree assault, third-degree arson and first-degree criminal use of a firearm.

Mr. Rabideau, a self-employed excavating contractor, continues to recover from his injury. He was released from the hospital Wednesday.

During the execution of a search warrant, State Police Bureau of Criminal Investigation Capt. Robert LaFountain said, the weapon suspected of having been used was recovered on the premises.

Officials completed their search of the crime site Thursday afternoon, LaFountain said Friday.

Reached Friday, Mr. Rabideau declined to comment on the shooting.

It was unclear when Mrs. Rabideau will return to court, and Gaudreau did not return a Press-Republican message seeking comment.
