Sentences handed down in Franklin County Court

---- — MALONE — A number of cases were processed in Franklin County Court recently, with prison sentences hand down in some instances.

Cases heard before Judge Robert G. Main Jr.:

Crystal Cook, 34, of Hogansburg pleaded not guilty to third-degree criminal sale of a controlled substance and third-degree criminal possession of a controlled substance, stemming from an incident Sept. 21. She is being held in County Jail in lieu of $5,000 bail or $10,000 insurance bond and is to reappear in court Jan. 17.

Melissa Papineau, 35, of McGee Road, Hogansburg pleaded not guilty to third-degree criminal sale of a controlled substance and third-degree criminal possession of a controlled substance, stemming from an incident Feb. 27. She is being held in County Jail in lieu of $5,000 bail or $10,000 insurance bond and is to reappear in court Jan. 17.

A 19-year-old Winthrop youth, who was given youthful-offender status, was sentenced to five years probation for third-degree burglary, stemming from an incident Feb. 29. He pleaded guilty to Superior Court Information rather than a formal grand-jury indictment and was also ordered to pay $500 in restitution.

Rory Larocque, 42, of Factory Street, Malone was sentenced to a year in state prison for fifth-degree criminal possession of a controlled substance, stemming from an incident June 7. He pleaded guilty to Superior Court Information rather than a formal grand-jury indictment and was also ordered to serve one year of post-release supervision and pay a $1,000 fine.

Brettani L. Heroy, 20, of Hogansburg pleaded guilty to fourth-degree grand larceny, stemming from an incident Dec. 18, 2011. She was originally indicted on three counts of second-degree criminal possession of a forged instrument and fourth-degree grand larceny.

Sentencing is set for Feb. 19.

Jennifer Williams, 39, of Schenectady pleaded not guilty to charges of first-degree promotion of prison contraband, third-degree attempted criminal sale of a controlled substance and seventh-degree criminal possession of a controlled substance, stemming from an incident Dec. 18, 2011. She was taken to County Jail in lieu of $5,000 cash bail or $10,000 insurance bond.

Kassi-Lynn Baublitz, 25, of Brasher Falls was sentenced to five years probation with the first two months in County Jail for third-degree burglary, stemming from an incident Feb. 29.

Adam J. Baublitz, 24, of Brasher Falls was sentenced to 3½ to seven years in state prison as a second-felony offender for third-degree burglary, stemming from an incident Feb. 29.

Amy Bingham, 43, of Fort Covington pleaded not guilty to driving while intoxicated and driving while intoxicated with a blood-alcohol level above .08, stemming from an incident July 4.

Darin W. York, 19, of Malone was sentenced to five years probation with the first six months in County Jail for fourth-degree grand larceny, stemming from an incident Oct. 26, 2011.

He was also ordered to serve six months on electronic-home monitoring and to pay $150 in restitution.

Grace Miola, 23, of Chateaugay was sentenced to two concurrent five-year terms in state prison and two years post-release supervision for third-degree criminal possession of a controlled substance, stemming from incidents on Feb. 15 and 21, May 10 and June 8.

She was ordered to pay $370 in restitution.

Pasquale Bosco, 51, of Brushton pleaded not guilty to two counts of first-degree unlawful imprisonment, second-degree menacing and fourth-degree criminal mischief, stemming from an incident Oct. 9.

Michael Lewis, 35, of Burke pleaded not guilty to third-degree criminal sale of a controlled substance and third-degree criminal possession of a controlled substance, stemming from an incident March 25.

Jordan Berry, 32, of Brushton pleaded not guilty to aggravated driving while intoxicated with a child passenger under 15, driving while intoxicated and consumption of alcohol in a motor vehicle, stemming from an incident July 30.

Jason LaBrake, 31 of Malone pleaded not guilty to first-degree aggravated unlicensed operation of a motor vehicle, driving while intoxicated, refusal to take a breath test, consumption of alcohol in a motor vehicle and failure to stop at a stop sign, stemming from an incident Oct. 11.

Reid St. Ann, 34, of Constable pleaded not guilty to first-degree unlicensed operation of a motor vehicle, driving while intoxicated and speeding, stemming from an incident July 1.

Jessica Brown, 30, of Fort Covington was sentenced to two concurrent terms of two years in state prison for third-degree criminal sale of a controlled substance and third-degree criminal possession of a controlled substance, stemming from an incident Jan. 13. The terms will run consecutive to two three-year terms that she was given for additional counts of third-degree criminal possession of a controlled substance, stemming from incidents on Jan. 12 and 19.

Desaraie M. Brown, 23, of Lake Street, Chateaugay was sentenced to five years probation with the first six months in County Jail for third-degree criminal sale of a controlled substance, stemming from an incident Dec. 22, 2011.

Louis Vargas, 31, an inmate at Mohawk Correctional Facility, was sentenced to 1½ to three years as a second-felony offender for first-degree attempted promotion of prison contraband, stemming from an incident March 4 at Upstate Correctional Facility in Malone.

The term will run consecutive to the time he is currently serving in prison.

Austin Bell, an inmate at Upstate Correctional Facility, was sentenced to 1½ to three years as a second-felony offender for first-degree attempted promotion of prison contraband, stemming from an incident Oct. 23, 2011, at Upstate Correctional Facility. The term will run consecutive to the time he is currently serving in prison.

Jahasson Booker, 21, an inmate at Coxsackie Correctional Facility, was sentenced to 1½ to three years as a second-felony offender for first-degree attempted promotion of prison contraband, stemming from an incident Aug. 30, 2011, at Bare Hill Correctional Facility in Malone. The term will run consecutive to the time he is currently serving in prison.

Patrick Jantzen, 23, an inmate at Upstate Correctional Facility, was sentenced to 1½ to three years as a second-felony offender for first-degree attempted promotion of prison contraband, stemming from an incident Sept. 6, 2011, at Bare Hill Correctional Facility. The term will run consecutive to the time he is currently serving in prison.

Angel Perez, 31, an inmate at Upstate Correctional Facility, was sentenced to 1½ to three years as a second-felony offender for first-degree attempted promotion of prison contraband, stemming from an incident Aug. 1, 2011, at Bare Hill Correctional Facility. The term will run consecutive to the time he is currently serving in prison.

Anna Fiacco, 26, of Endicott was sentenced to one year of probation after pleading guilty as a second-felony offender to two counts of third-degree attempted criminal sale of a controlled substance, stemming from incidents May 17 and May 19, 2011.

Cases heard before Acting County Court Judge John Hall:

Braylin Jones, 21, of McKenzie Pond Road, Saranac Lake was sentenced to five years probation with the first six months in County Jail for third-degree attempted burglary, stemming from four burglaries in the Town of Franklin in September and October 2011.

Jones was ordered to pay $1,400 in restitution, $325 in surcharges and fees, a $50 fee for providing a DNA sample and a $5,000 fine. The break-ins were on Paye Road, Muzzey Road, Tyler Road and Fletcher Farm Road.
