TO THE EDITOR: I just read the May 29, 2013, article about Essex County being outraged about the “lack of information sharing” by Frontier regarding the phone-service outage. Essex County should look in the mirror.
On Feb. 27, I filed a Freedom of Information request with the Essex County FOIL Officer. Under the Freedom of Information Law, a response is required within five business days.
On March 11, I sent a reminder. On March 15, I had to send another reminder. On March 20, I sent a third reminder that I had not received the response required by law.
On March 21, I received an email from the county FOIL officer that he will evaluate the request and I would receive the “allowable” documents by March 26 (20 business days from the original request). Nothing was received, and nothing was heard.
On April 2, I emailed another reminder. On April 4, I filed an appeal based on a denial due to no response within the time limits. There was still no response from the county.
On May 10, I contacted the Committee on Open Government in Albany and informed them of the situation. The information I requested was then mailed out to me that very day.
I think that while Supervisor Randy Douglas is doing a “full investigative report” on the lack of information from Frontier of the phone outage, he should also do a full investigation on the county’s information issues.
The FOIL law stipulates 20 business days or less to furnish FOIL requests. It took the county 52 business days to send the information requested and only after I involved the Committee on Open Government.
