PLATTSBURGH &mdash. An inmate at Clinton Correctional Facility was found not guilty of felony charges.
Josue Deliser was indicted on charges of third-degree criminal possession of a weapon and first-degree promoting prison contraband, both felonies.
It is alleged that Deliser possessed a sharpened toothbrush while in a hallway of the prison on March 12, 2011, which he denied, according to a press release from O’Connell and Aronowitz law firm.
Clinton County Assistant District Attorney Nicholas Evanovich served as prosecutor.
Deliser was represented by attorney Dean C. Schneller.
Schneller’s defense focused on the inability of the corrections officer to accurately observe Deliser in a crowded hallway, the fact that Deliser was attacked by two other inmates, and the lack of objective proof, such as fingerprints or video-tape evidence, according to the release.
