CHATEAUGAY — A Burke man was charged Nov. 21 with drunken driving.
At about 5:45 p.m., State Police responded to a one-car accident on Route 23 in Chateaugay, said Malone-based State Police.
Donald Cuomo, 61, told police he swerved to avoid a vehicle in the roadway, then overcorrected and lost control of the vehicle, which left the roadway and struck a fence and a tree, police said.
Cuomo refused medical treatment, police said.
During a breath test, Cuomo’s blood-alcohol content was found to be .16 percent, police said.
He was charged with felony driving while intoxicated and two traffic infractions: operating a motor vehicle out of license class and moving from a lane unsafely.
Cuomo was arraigned in Burke Town Court and was released into the supervision of the Franklin County Probation Department.
He is due back in court on Jan. 8.
