Franklin County Court Sentencings

MALONE — Judge Robert G. Main Jr. handled a number of cases in Franklin County Court by County Court recently.

Here are the outcomes:

Robbie Eseltine, 23, of Constable, was sentenced to three years in state prison for fourth-degree attempted sale of a controlled substance, stemming from an incident May 27, 2013.

He was also ordered to serve two years of post-release supervision, pay a $5,000 fine and $116 in restitution.

Eseltine was originally charged with third-degree criminal sale of a controlled substance, third-degree criminal possession of a controlled substance, two counts of fourth-degree criminal sale of a controlled substance and two counts of fifth-degree criminal possession of a controlled substance.

Harley Bell, 24, of Brushton was sentenced to five years of probation with the first six months in County Jail for third-degree burglary and two concurrent five-year probation terms for two additional counts of third-degree burglary, stemming from separate incidents in August 2013.

He was also ordered to pay $19,590 in restitution.

Bell was originally charged with four counts of third-degree burglary and two counts of petit larceny.

Ronald Cyrus, 22, of Malone pleaded not guilty to a grand-jury indictment charging him with second-degree burglary, stemming from an incident Dec. 6, 2013.

He was taken to County Jail in lieu of $15,000 cash bail or $30,000 insurance bond.

Luis Colon, 23, an inmate at Upstate Correctional Facility, pleaded guilty to first-degree attempted promotion of prison contraband, stemming from an incident on Aug. 10, 2013, at Franklin Correctional Facility.

Sentencing is set for May 12.

Donald Cuomo, 51, of Burke pleaded not guilty to a grand-jury indictment charging him with driving while intoxicated for having a blood-alcohol content higher than .08 percent, felony DWI and moving unsafely from a driving lane, stemming from an incident Nov. 21, 2013.

Michael Tatum, 21, an inmate at Upstate Correctional Facility, pleaded guilty to first-degree attempted promotion of prison contraband, stemming from an incident June 22, 2013, at Bare Hill Correctional Facility.
