Sentences handed down in Franklin County Court

---- — MALONE — Franklin County Court Judge Robert G. Main Jr. presided over a number of cases recently.

Jason M. LaBrake, 32, of Edward Street, Malone was sentenced to five years probation for first-degree aggravated unlicensed operation of a motor vehicle, stemming from an incident Oct. 11, 2012. He was indicted by a grand jury for unlicensed operation, driving while intoxicated, refusing to take a breath test, drinking alcohol in a motor vehicle and failure to stop at a stop sign. LaBrake was also ordered to pay a $1,000 fine and had his driver’s license revoked.

Pasquale Bosco, 51, of Brushton was sentenced to concurrent terms of five years probation, with the first three months in County Jail, for two counts of first-degree unlawful imprisonment, stemming from an incident Oct. 9, 2012.

He was ordered to pay a $1,500 fine for each charge.

Sherrie D. Graham, 39, of Binghamton was sentenced to five years probation, with the first six months in County Jail, for first-degree attempted promotion of prison contraband, stemming from an incident April 15 at Bare Hill Correctional Facility. She was indicted by a grand jury for two counts of first-degree promotion of prison contraband, fifth-degree criminal possession of a controlled substance, fifth-degree criminal possession of marijuana, third-degree criminal sale of marijuana and fifth-degree criminal sale of a controlled substance.

Jordan Berry, 32, of Grove Street, Malone was sentenced to five years probation, with the first six months in County Jail, for aggravated driving while intoxicated with a child passenger under age 15, stemming from an incident July 30, 2012. He was also ordered to pay a $5,000 fine, and his license was revoked.

Reid St. Ann, 34, of Foy-Eldred Road, Bombay was sentenced to a stayed term of five years probation, with the first six months in County Jail, for first-degree aggravated unlicensed operation of a motor vehicle and a stayed term of three years probation, with the first two months in County Jail, for driving while intoxicated, stemming from an incident July 1, 2012. He was also ordered to pay a $1,000 fine on each count.

Ernest Duvall, 58, pleaded guilty to Superior Court Information rather than a formal grand-jury indictment for failure to register as a sex offender, stemming from an incident June 26, 2013. Sentencing is set for April 15. According to the NYS Sex Offender Registry, Duvall is an inmate at Bare Hill Correctional Facility in Malone. In 1997, he was convicted of first-degree rape of a 10-year-old child. According to the state’s Inmate Lookup website, he had been released in May of last year after serving 15 years on the rape conviction.

Bernard McCormick, 29, of Franklin Ave., Saranac Lake pleaded not guilty to third-degree assault as a hate crime, stemming from an incident Oct. 27, 2010. A conference was set for April 4, and he was taken to County Jail in lieu of $2,500 cash bail or $5,000 insurance bond.

Jason Fuller, 30, of Burke pleaded not guilty to a grand-jury indictment charging him with three counts each of third-degree criminal sale of a controlled substance and third-degree criminal possession of a controlled substance, stemming from incidents on May 12, May 23 and Nov. 26.

A conference is set for April 4, and he was taken to County Jail in lieu of $10,000 cash bail or $20,000 insurance bond.
