TUPPER LAKE -- A man faces a felony charge after he allegedly driving while intoxicated.
Tupper Lake Village Police reported Kevin Smith, 39, of Norwich was stopped at 1:34 a.m. Sunday because he was driving in the center lane of Demars Boulevard. As police investigated, they determined he was intoxicated.
Smith was charged with felony driving while intoxicated due to a previous DWI conviction within the last 10 years. He was also charged with driving with a blood alcohol content of more than .08, a misdemeanor, and ticketed for driving in the center lane.
Smith was arraigned before Tupper Lake Village Justice Michael Demars and released on his own recognizance. He is scheduled to reappear in Village Court at 5 p.m. May 19.
