Sex offender charged with DWI with child passenger

MALONE — A Malone man who assaulted a pregnant woman in 2001 was arrested recently in connection with a domestic dispute.

On Jan. 3, Clayton R. Tucker, 36, was charged with first-offense aggravated DWI with a child passenger, a felony; DWI first offense, a misdemeanor; two counts of acting in a manner to injure a child younger than 17, a misdemeanor; and third-degree assault with intent to cause physical injury, a misdemeanor.

Malone-based State Police said the incident centered on a domestic dispute involving Tucker’s girlfriend, Maria L. White, 20, of Malone, and a child, but troopers said they couldn’t elaborate.

At least one person suffered minor injuries, police said, but they would not give specifics.

White was charged with one count of acting in a manner to injure a child younger than 17.

White and Tucker were arraigned in Bangor Town Court  on Jan. 3 and were both sent to Franklin County Jail.

White’s bail was set at $500 cash or $1,000 bond; she posted bail Jan. 4, according to the Franklin County Sheriff’s Department.

Tucker is due to appear in court Tuesday, according to the Sheriff’s Department.

His bail set was at $25,000 cash or $50,000 bond, and he remained in jail as of Friday morning.

Franklin County Assistant District Attorney Elizabeth Crawford said she could release no further details.

PRIOR CRIME

In January of 2010, Tucker was charged with failure to report a change of address as a sex offender, which is a felony.

Nine years earlier, in 2001, he was accused of punching and kicking a pregnant woman in an attempt to kill her unborn child.

The woman miscarried as a result of the assault.

Tucker pleaded guilty to second-degree abortion and was sentenced in 2002 to two to four years in state prison.

He was released conditionally from prison to the supervision of New York State Division of Parole in May 2004, according to the New York State Department of Corrections and Community Supervision’s website.
